Judgment against Austrian Pro-Lifers.

On April 4, the single judge Erik Nauta, of the regional court of Graz, sentenced four pro-lifers to high penalties for stalking.

They are charged with having repeatedly stalked the Graz-based abortionist, Johannes Hanfstingl.

Judge Nauta also convicted the Austrian director of the pro-life organization Human Life International, Dietmar Fischer, for stalking in Graz – although the latter works in Vienna not Graz. His fine is 180 daily rates of 40 euros each totaling 7.200 euros. ($10,000.00 US Dollars)

Furthermore, the two activists who offered help on the sidewalks and one woman who worked as a consultant were sentenced to fines between 450 and 840 euros. ($600.00 - $1200.00 USD)

Gloria.tv is in possession of the contradictory reasons given for the judgment as well as the appeal made against the unjust verdict.

Nauta claims that the accused had deliberately planned to stalk the abortionist.

The pro-lifers responded by saying that in Graz – as in many other places around the world – they were trying to assist expectant mothers who were ready to abort their unborn babies.

Two pro-lifers were alleged to have handed the mothers brochures, flyers and plastic embryos with the aim of having the women “inform him [the abortionist] of these occurrences” – as the judgment repeats.

Then, judge Nauta claims that the pro-lifers had used the informative material in order to “get in contact with Dr. Hanfstingl”.

The alleged victim of the stalking responded to the question of whether the mothers wanted to bring him any message, “I don't think so, I think that the patients were primarily supposed to get information.”

Without exception, the eight witnesses for the prosecution all testified in favor of the pro-lifers. In addition, they all stated that they had not been bothered or harassed in any form whatsoever.

At court, they testified that they had “not been bothered” by the pro-lifers. Seven of the eight witnesses had never even been addressed by the pro-lifers. Only one of them received informative material.

Despite these testimonies, judge Nauta explains, in the reasons for his judgment, that the pro-lifers had sought to contact “all patients” of the abortionist.

The most bizzare of all the allegations is the stalking verdict against the Vienna-based director of Human Life International, Dietmar Fischer.

During the past years he rarely ever was to Graz and never worked in front of the baby-killing clinic of Hanfstingl.

In the case of Dietmar Fischer too, judge Nauta does sloppy work. For example, the judgment gives a wrong address for Fischer. Additionally, at one point instead of “Dietmar Fischer”, the judge calls him “Heinz Fischer” which is the name of the president of Austria.

The judge also considered the monthly prayer rallies, that were permitted by the police, as part of the stalking activities. During these rallies, 60 to 100 people legally walk through the city center of Graz.

For the judge, these legal processions indicate the intention of the accused to stalk the abortionist.

Yet, these rallies always take place on Saturdays and the abortionist does not work on Saturdays.

Consider the situation from the other point of view, i.e. of pure law: regardless of reason, e.g. love, hate, mental illness, stalking of a citizen leads to all sorts of invasion of privacy, harassment, etc.

On the other hand, the abortionist doctors need to know that what they are doing is indeed wrong and is no less than murder. Therefore, what is one to do? The peaceful protesting within the confines of the law just might be the answer..... (?)

Sounds to me that the judge is not pro-life, hence the costly verdict despite the evidence for those keeping a regular peaceful protest. Stalking has a broad definition - commonly used to refer to unwanted, obsessive attention by individuals (and sometimes groups of people) to others. In our country, we're required to stay at a goodly distance to lessen any feeling of being threatened by those entering clinics and they're at liberty to approach for information or not.
