They understand throwing out an arrest would be a 'bad precedent' to set and will jeapordize their own career advancement.

Historically, most unlawful arrest charges get overturned by juries during trials for much more serious charges. Or, when the "jury" takes the form of widespread public outrage at some truly horrible excess by the police. Even then, it's common to see verdicts with a conviction for one or two minor literally inconsequential charges (e.g. "disorderly conduct") simply to justify the arrest.

We've all been living in a police state for a very long time now, this "emergency" is finally making that clear.
